Mechanics Liens
Mechanics liens are often used in the construction industry to assure payment on work performed (also referred to as a construction lien at times). A Mechanic Lien is essentially a lien on property, and may be foreclosed on by a general contractor or a subcontractor in the event of non-payment. Certain procedures must be followed at the outset of the transaction (i.e. file lien) in order to assure that all work performed in connection with a particular construction project may be covered under the property lien. As progress payments are made in connection with the work performed, a general contractor and/or subcontractor issue a lien release or lien waivers as to the portion of payment received. If payments are not received in connection with work performed, a mechanics lien may be foreclosed on. Mechanics liens are an integral part of construction law and are commonly used in nearly all construction projects.
