HOA
Homeowners Associations, also known as HOA’s, have become the standard in nearly all new developments in the Phoenix metropolitan area, and throughout the State of Arizona, in the last decade. Typically, the community establishes Conditions, Covenants & Restrictions, or CC&R in short, which are the governing rules over the community, and with which every homeowner within the developed community is bound. The HOA is governed by a Board of Directors, often referred to as the Board, whose responsibility is to enforce the CC&R’s of the community. The CC&R’s typically establish the size of the Board, the methods by which available positions on the Board are filled (i.e. elections), election procedures, etc. The Board often operates in conjunction with a management company, which may assist in the enforcement of the CC&R’s; the collection of assessments (also referred to as HOA fees or HOA dues) that homeowners within the community are required to pay; and with general HOA management issues that may arise from time to time. While community associations are most often encountered in the context of condominium associations in Arizona, homeowner association law, or HOA law, equally applies to single-family residential housing communities alike.
