Custody
Having custody of a child refers to the ability of a parent or a legal guardian to make decisions on behalf of that child. As in the case with child support and parenting time, Arizona divorce lawyers often address child custody issues in the context of a family divorce, subject to current Arizona family law. With that in mind, however, child custody is different than parenting time arrangements, or the parental duty to support a child.
There are two types of custody arrangements: Joint Legal Custody, and Sole Legal Custody. Joint Legal Custody or Shared Custody requires both parents to work together to reach major decisions with respect to their children, while Sole Legal Custody or Full Custody gives one parent the ability to make decision on behalf of the children, to the exclusion of the other.
Arizona courts factor each individual’s unique circumstance to determine child support and custody issues. Typically, absent domestic violation, a presumption that Joint Legal Custody is in the best interest of a child exists when both parents and fit and proper, in the Court’s opinion, to make decisions on behalf of their children.
