Landlord-Tenant Disputes
A Lease Agreement, whether residential or commercial, creates a landlord-tenant relationship which gives rise to certain rights and obligations on both the Landlord and Tenant, as they relate to the underlying property. While the parties’ respective interests in the lease – the Tenant’s being the right to possession, and the Landlord’s being the collection of rent – is mutually beneficial to both parties, the landlord-tenant relationship often results in legal disputes, typically involving tenants’ eviction actions, also known as forcible detainers; tenants’ rights, also referred to as renters’ rights; and the parties’ competing claims for the right of possession with respect to the property in question.
In the context of residential leases, the Arizona Residential Landlord and Tenant Act (most commonly referred to as landlord tenant laws) controls the parties respective rights and obligations with respect to the underlying property, and provides for the proper remedies the Landlord or Tenant are entitled to pursue under in any given landlord-tenant dispute. While Landlords may often commence eviction actions against their tenants for a variety of reasons that constitute a breach under the Lease Agreement or other statutory provisions, Tenants are also entitled to certain remedies in the event the Landlord fails to meet his/her obligations under the Lease or applicable statutes.
In the context of evictions, Landlords must provide the Tenants with a notice of their intent to evict before the eviction process can commence. There are ways for Tenants to avoid tenants’ eviction after receiving the Landlords’ notice, and before the eviction action commences, if Landlords’ issues are properly addressed by the Tenant without delay.
